1. Introduction

Welcome to ElkDesk. These Terms of Service govern your use of our AI-powered email support platform operated by CurlyCorn LLC. By accessing or using ElkDesk, you agree to be bound by these terms.

2. Use of Service

ElkDesk provides email support management tools including AI-powered reply suggestions, ticket organization, and team collaboration features. You agree to use the service only for lawful purposes and in accordance with these terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Accounts

To use ElkDesk, you must create an account and provide accurate, complete information. You must be at least 18 years old or have the legal capacity to enter into these terms.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent or harmful activities.

4. Subscription and Billing

ElkDesk offers subscription plans with varying features and limits. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Web Subscriptions: Payments made through our website are processed by Stripe. You can manage your subscription and billing details through the ElkDesk settings or the Stripe customer portal.

Mobile Subscriptions (iOS & Android): Payments made through our mobile app are processed by Apple (via the App Store) or Google (via Google Play), depending on your device. These purchases are subject to the terms and policies of the respective app store, including their refund and cancellation policies. To manage or cancel a mobile subscription, use the subscription settings in your Apple ID or Google Play account. ElkDesk does not have the ability to issue refunds for purchases made through the App Store or Google Play—please contact Apple or Google directly for refund requests.

You may cancel your subscription at any time. For web subscriptions, refunds are handled in accordance with our refund policy. For mobile subscriptions, the refund policies of the Apple App Store or Google Play Store apply.

5. Intellectual Property

ElkDesk and its original content, features, and functionality are owned by CurlyCorn LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of the content you submit through the service. By submitting content, you grant us a license to use it as necessary to provide the service.

6. AI-Generated Content

ElkDesk uses artificial intelligence to generate reply suggestions and analyze emails. While we strive for accuracy, AI-generated content should be reviewed before sending. You are responsible for all communications sent through your account.

7. Limitation of Liability

To the maximum extent permitted by law, CurlyCorn LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

8. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

9. Indemnification

You agree to indemnify, defend, and hold harmless CurlyCorn LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time directly from the Settings page within the app. Upon termination, your right to use the service ceases immediately, though certain provisions of these Terms will survive termination.

Before deleting your account, you can export your project data from the Settings page.

Deleting your account does not automatically cancel an active subscription. If you subscribed through the web, cancel your plan in billing settings before deleting your account. If you subscribed through the Apple App Store or Google Play Store, you must cancel the subscription through your Apple ID or Google Play account settings, as ElkDesk cannot cancel app store subscriptions on your behalf.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Mexico.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended economic and legal purpose.

13. Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by posting the new terms on this page and updating the “Last updated” date.
